Bespoke Charleston is a travel advisory service helping travelers (“you,” “traveler,” or “client”) plan seamless, memorable trips.

1. Contract

These Terms and Conditions (“Agreement”) form a legally binding contract between you and Bespoke Charleston. By requesting or confirming a booking, submitting payment, signing, or clicking “I agree,” you acknowledge you’ve read, understand, and agree to this Agreement.

This Agreement incorporates:

  • All communications, proposals, and correspondence between you and us

  • All Supplier (third-party) terms and policies

  • All waivers and notices contained herein

If you are booking for others, you confirm you are authorized to act for all travelers, will share these Terms with them, and accept financial responsibility for the booking.

You represent that all information provided is accurate and that you are of legal age and authority to enter into contracts.

2. Scope of Services & Agency Relationship

Bespoke Charleston acts solely as an independent travel advisor, arranging travel services provided by independent third-party Suppliers (including but not limited to hotels, transportation companies, tour operators, and activity providers).

We do not own, operate, control, or manage Supplier services. Suppliers have their own terms, conditions, cancellation/refund policies, schedules, and operational standards, which apply to your booking.

Bespoke Charleston is not responsible for:

  • Acts, errors, omissions, negligence, or insolvency of Suppliers

  • Supplier schedule changes, delays, or service interruptions

  • Events outside our control

3. Booking & Payment

Process:

  1. You contact us with preferences.

  2. We outline planning steps, fees, and proposal timelines.

  3. After approval, you complete required authorizations and pay planning fees and/or deposits.

  4. Deposits are paid to Suppliers; planning fees are paid to Bespoke Charleston.

Important:

  • Planning/consulting fees are non-refundable and due before research begins.

  • All deposit and balance deadlines are controlled by Supplier terms.

  • Bookings made close to travel dates may require payment in full at booking.

  • Failure to pay on time may result in cancellation and loss of funds per Supplier policies.

4. Price & Rate Changes

Until final payment is made, prices may change due to:

  • Supplier rate changes

  • Tax or fuel surcharges

  • Currency fluctuations

If a pricing error occurs prior to final payment, we may correct it. Prices are locked only after final payment.

5. Changes & Cancellations

By Traveler:
All change or cancellation requests must be submitted in writing to kaitlin@bespokecharlestontravel.com.

Planning fees remain non-refundable. Supplier terms control any refunds, credits, or penalties. Some bookings are strictly non-refundable.

By Suppliers:
If a Supplier cancels or alters services, we will notify you and assist in alternatives. Our responsibility ends at providing assistance; additional compensation is not guaranteed.

No refunds for unused portions of travel once the trip has begun.

6. Force Majeure

We are not liable for losses, delays, or expenses resulting from events beyond our control, including but not limited to: natural disasters, pandemics, government restrictions, war, terrorism, weather, labor strikes, or Supplier failure.

Refunds are not guaranteed in force majeure events; we will help request Supplier credits where possible.

7. Travel Protection Insurance

Travel insurance is strongly recommended, including:

  • Trip cancellation/interruption

  • Medical and evacuation coverage

  • “Cancel for any reason” options (if desired)

We are not insurance producers and cannot guarantee coverage or outcomes.
If you decline insurance, you assume financial responsibility for all non-covered losses.

8. Traveler Responsibilities

You are responsible for:

  • Providing accurate personal and travel information

  • Ensuring all travelers’ names match government ID/passport

  • Verifying all confirmations, documentation, and itineraries immediately

  • Understanding and obtaining required passports, visas, immunizations, and entry requirements

  • Compliance with Supplier policies and local laws

Costs arising from documentation errors or non-compliance are your responsibility.

9. Credit Card Authorization & Chargebacks

By submitting payment, you authorize charges according to this Agreement and Supplier terms. You agree to contact Bespoke Charleston first regarding any billing concern before initiating a chargeback.

We may dispute improper chargebacks and recover related costs.

10. Limitation of Liability

To the fullest extent permitted by law, Bespoke Charleston’s total liability is limited to the planning fees and/or commissions actually received from you for the specific booking.
We are not liable for indirect, incidental, punitive, or consequential damages.

11. Assumption of Risk & Waiver

Travel involves inherent risks, including illness (including COVID-19), injury, property loss, transportation disruptions, and environmental hazards. You voluntarily assume these risks and release Bespoke Charleston from liability except in cases of gross negligence or willful misconduct.

12. Indemnification

You agree to indemnify and hold harmless Bespoke Charleston from losses arising out of:

  • Your breach of this Agreement

  • Your negligence or misconduct

  • Claims made by other travelers in your party

13. Conduct & Supplier Rights

Suppliers may deny service to travelers who:

  • Violate rules or laws

  • Behave disorderly or dangerously

  • Endanger others

No refunds will be issued in such cases.

14. Accessibility, Health Conditions & Pregnancy

Please disclose medical conditions, accessibility needs, and mobility considerations before booking so we can request accommodations. Availability is not guaranteed.

15. Intellectual Property & Media Use

All itineraries, travel guides, trip materials, and design elements are the intellectual property of Bespoke Charleston and may not be reproduced or distributed without written permission.

If you share photos, testimonials, or tag Bespoke Charleston on social media, you grant us permission to re-share for marketing unless you request removal by emailing kaitlin@bespokecharlestontravel.com.

16. Website Terms & Privacy

By using our website, you agree to our Privacy Policy located at: bespokecharlestontravel.com

17. Affiliate Disclosure

We may receive commission or referral compensation from bookings made through our partners. This does not affect your price and does not influence our recommendations.

18. Dispute Resolution, Governing Law & Venue

This Agreement is governed by the laws of the State of Georgia.
Disputes will be resolved through binding arbitration in Gwinnett County, Georgia under the rules of the American Arbitration Association.

19. Severability & Modifications

If any provision is found invalid, the remaining terms remain enforceable.
We may update these Terms at any time; the latest version will always appear at: bespokecharlestontravel.com

ACKNOWLEDGMENT

By booking travel, submitting payment, or clicking “I agree,” you confirm that you have read, understand, and agree to be bound by these Terms & Conditions.
